Below is the text of the membership agreement between Gece Kıvılcımı and the Gece Kıvılcımı member. Please read this agreement carefully before becoming a member of Gece Kıvılcımı and do not complete your membership without approving all the articles contained in the agreement.

Aşağıdaki, Gece Kıvılcımı ile Gece Kıvılcımı üyesi arasındaki üyelik sözleşmesinin metnidir. Gece Kıvılcımı'na üye olmadan önce lütfen bu sözleşmeyi dikkatle okuyunuz ve sözleşmenin içerdiği tüm maddeleri onaylamadan üyeliğinizi tamamlamayınız.

1. PARTIES

1. TARAFLAR

This agreement is drawn up between the Gece Kıvılcımı App ("Gece Kıvılcımı") and the person who becomes a member ("Member"), concluded at the moment it is approved by the member electronically, and entered into force mutually.

İşbu sözleşme, Gece Kıvılcımı Uygulaması ("Gece Kıvılcımı") ile üye olan kişi ("Üye") arasında düzenlenmiş, elektronik ortamda üye tarafından onaylanması anında akdedilmiş ve karşılıklı olarak yürürlülüğe girmiştir.

2. DEFINITIONS

• Site: The website broadcasting at gecekivilcimi.kgroupsoftware.com.
• Member: The person who has filled out the form at gecekivilcimi.kgroupsoftware.com, checked the box at the beginning of the statement "I have read and accept the Membership Agreement," and completed the membership process by clicking the "Sign Up" button.
• Standard Membership: The standard membership type created by the member by entering the information in the profile area to be used in Gece Kıvılcımı; it includes a daily message limit.
• Premium Membership: A paid membership type that gives the right to use the parts specified in the Gece Kıvılcımı standard membership unconditionally.
• Coins: A feature purchased for the fees determined on the Site, allowing users to benefit from privileges.
• Member Profile: An interactive area created on the Site with the information provided by the member.

• Site: gecekivilcimi.kgroupsoftware.com adresinde yayın yapan internet sitesi.
• Üye: gecekivilcimi.kgroupsoftware.com adresinde yer alan formu doldurmuş, "Üyelik Sözleşmesi'ni okudum, kabul ediyorum." ifadesinin başındaki kutucuğu işaretlemiş ve "Üye Ol" butonuna basarak üye olma sürecini tamamlamış kişi.
• Standart Üyelik: Üyenin Gece Kıvılcımı'nda kullanılacak olan profil alanındaki bilgileri girerek oluşturduğu; günlük mesaj hakkı içeren standart üyelik şeklidir.
• Premium Üyelik: Gece Kıvılcımı standart üyelikte belirtilen kısımları sınırsız olarak kullanma hakkı veren ücrete tabi üyelik şeklidir.
• Coins: Sitede belirlenen ücretler karşılığında alınan, ayrıcalıklardan yararlanma imkânı veren özelliktir.
• Üye Profili: Sitede üyenin kendisinin verdiği bilgilerle oluşturulan interaktif alan.

3. SUBJECT OF THE AGREEMENT

3. SÖZLEŞMENİN KONUSU

The subject of this agreement is the determination of the services offered, the conditions of use, and the rights and obligations of the parties. By accepting the provisions of this agreement, the member is deemed to have accepted any declaration made by Gece Kıvılcımı.

İşbu sözleşmenin konusu, sunulan hizmetlerin, yararlanma şartlarının ve tarafların hak ve yükümlülüklerinin tespitidir. Üye, işbu sözleşme hükümlerini kabul etmekle Gece Kıvılcımı tarafından açıklanan her türlü beyanı da kabul etmiş olmaktadır.

4. RIGHTS AND OBLIGATIONS OF MEMBERS

4. ÜYELERİN HAK VE YÜKÜMLÜLÜKLERİ

• 4.1. The member agrees to act in accordance with all the conditions in this agreement during their membership.
• 4.2. It is mandatory to be over 18 years of age. In case of inconsistency in the information, the membership is canceled.
• 4.3. Advertising, insults, and racism cannot be made on profiles. Personal contact information cannot be shared.
• 4.4. The security of the system access tools belongs to the member.
• 4.5. Gece Kıvılcımı may share member information with official authorities in case of legal requests.
• 4.6. If content that constitutes a crime is shared, the membership is terminated immediately.

• 4.1. Üye, üyeliği süresince işbu sözleşme içerisindeki tüm şartlara uygun hareket edeceğini kabul eder.
• 4.2. 18 yaşını doldurmuş olmak şarttır. Bilgilerde tutarsızlık halinde üyelik iptal edilir.
• 4.3. Profillerde reklam, hakaret, ırkçılık yapılamaz. Kişisel iletişim bilgileri paylaşılamaz.
• 4.4. Sisteme erişim araçlarının güvenliği üyeye aittir.
• 4.5. Gece Kıvılcımı, yasal talepler halinde üye bilgilerini resmi makamlarla paylaşabilir.
• 4.6. Suç teşkil eden içerik paylaşılması halinde üyelik derhal sonlandırılır.

5. RIGHTS AND OBLIGATIONS OF GECE KIVILCIMI

5. GECE KIVILCIMI'NIN HAK VE YÜKÜMLÜLÜKLERİ

Gece Kıvılcımı reserves the right to change the services offered on the site. Refund processes for purchases made through application platforms must be made directly through the platform.

Gece Kıvılcımı, sitede sunulan hizmetleri değiştirebilme hakkını saklı tutar. Uygulama platformları üzerinden yapılan satın alımlardaki iade işlemleri doğrudan platform üzerinden yapılmalıdır.

6. LIMITED LIABILITY

6. SINIRLI SORUMLULUK

Gece Kıvılcımı cannot be held responsible for any direct or indirect damage suffered by members or third parties.

Gece Kıvılcımı, üyelerin veya 3. kişilerin uğradığı dolaylı veya direkt hiçbir zarardan sorumlu tutulamaz.

7. INTELLECTUAL PROPERTY RIGHTS

7. FİKRİ MÜLKİYET HAKLARI

The design, text, and code of the site belong to Gece Kıvılcımı. Members cannot use or share copyrighted works without permission.

Sitenin tasarımı, metni, kodu Gece Kıvılcımı'na aittir. Üyeler, telif haklarına tabi çalışmaları izinsiz kullanamaz, paylaşamaz.

8. FORCE MAJEURE

8. MÜCBİR SEBEPLER

In all cases deemed legally force majeure, Gece Kıvılcımı is not liable due to late or incomplete performance.

Hukuken mücbir sebep sayılan tüm durumlarda Gece Kıvılcımı geç veya eksik ifa etme nedeniyle yükümlü değildir.

9. APPLICABLE LAW AND JURISDICTION

9. UYGULANACAK HUKUK VE YETKİ

Turkish Law will apply to the implementation of this Agreement. Istanbul Courts are authorized in disputes.

İşbu Sözleşmenin uygulanmasında Türk Hukuku uygulanacaktır. İhtilaflarda İstanbul Mahkemeleri yetkilidir.

10. TERMINATION OF THE AGREEMENT

10. SÖZLEŞMENİN FESHİ

The membership is valid until it is canceled. In case of violation, Gece Kıvılcımı has the right of unilateral termination.

Üyelik iptal edilinceye kadar geçerlidir. İhlal halinde Gece Kıvılcımı tek taraflı fesih hakkına sahiptir.
